Washington DC, August 10, 2007 – The Central Intelligence Agency has lost documents concerning its investigation of the mysterious 1948 murder of CBS reporter George Polk, and destroyed its file on FOIA requests for Polk documents, according to a letter from Archivist of the United States Allen Weinstein. In June 2006, the Archive asked the CIA and the National Archives to investigate the possibility that the CIA had lost or destroyed records on the Polk case.

Polk, a CBS reporter based in Greece at the height of its left-right civil war, was murdered by unknown assailants in 1948. At the request of members of the Polk family, the National Security Archive had asked the CIA to re-review CIA documents on the Polk case that had been released during the 1990s. The CIA found a number of documents for re-review but in December 2005 informed the Archive that nine of the documents, including memoranda to the Agency’s director, had been destroyed. According to CIA Information and Privacy Coordinator Scott Koch’s letter, “The original documents had been destroyed in accordance with approved National Archives and Records Administration records schedules.” It was the CIA’s response that prompted National Security Archive director Thomas S. Blanton to write letters to the Archivist of the United States and the Inspector General of the Central Intelligence Agency asking them to investigate the destruction of documents on the Polk case.

Last week, Dr. Weinstein informed the National Security Archive that the CIA is “unable to locate the original documents or information about their disposition.” As the letter explains, the CIA FOIA case file had been destroyed in accordance with the records schedule; what has gone missing are the original file copies of the Polk-related documents (and whatever collection to which they belonged). That the CIA has determined that the documents cannot be found (and may well have been destroyed) raises troubling questions about CIA’s historical records preservation policies. Why is the CIA losing what should have been permanent records? If the Polk documents were part of a larger system of records that was destroyed, what other historically significant records no longer exist? That the FOIA file which contained copies of the now-missing documents had also been destroyed also raises questions about this standard practice at federal agencies.

The Polk Conspiracy: Murder and Cover-up in the Case of CBS News Correspondent George Polk

It is more than 40 years since CBS radio correspondent George Polk was murdered in Salonika, Greece. But as Kati Marton shows in her compelling new account of the Polk case, the life and death of this young reporter still epitomize the struggle between journalists committed to discovering the truth and governments determined to manipulate it.

Polk died in May 1948, apparently the victim of a civil war between an unusually harsh right-wing oligarchy and battle-hardened left-wing guerillas led by the Greek Communist party. His murder posed a potential diplomatic problem. In its effort to contain communism, the United States under the Truman Doctrine had thrown it support to the Greek rightists. In his coverage Polk had fearlessly documented the brutality and corruption of the Greek elite, despite a stream on anonymous death threats and expressions of unhappiness from American officials. It it had come out that the reporter had been murdered on the orders of the Greek regime, it might well have weakened domestic support for U.S. policy.

Polk's death led to several investigations, one headed by the columnist Walter Lippmann and directed by General William (''Wild Bill'') Donovan, former head of the OSS. The FBI and CIA were drawn in as well. A suspect was finally produced by the Greek police, and a ''confession'' extracted (through the use of torture, it later turned out). In a show trial, this suspect testified (falsely, as Morton confirms) that he had helped local Communist guerillas murder Polk.

Lippmann and Donovan — who were both in position to know better — were pleased with this politically expedient outcome. But doubts about the Polk case lingered. In 1977, Col. James Kellis, a U.S. investigator who had been abruptly removed from the case in 1948 at he behest of diplomats in Athens and Washington, swore in an affidavit that Polk's death had been arranged by "a handful of right-wing fanatics and their British allies," and that American officials had colluded in a cover-up.

This is a conclusion that Marton upholds in her absorbing chronicle. Drawing upon letters, journals, interviews, and previously classified government documents, she also penetrates the Byzantine workings of the ''legal, paralegal, and illegal security services,'' both Greek and American, involved in the case. Her chapters on the mysterious theft of Polk's files after his death give her narrative the pace and texture of an espionage thriller.

The Polk Conspiracy is also surprisingly timely. Once again the United States is embroiled in a foreign conflict; once again the State Department and the military are making an effort, in the name of national security, to control the flow of news. Though George Polk belongs to a more innocent era of American journalism, he remains a model of courage, idealism, and blunt honesty. A-

It was an important event in the post-war history of the U.S. media, yet the murder in Greece of CBS’s George Polk in May 1948 has generated a surprisingly small crop of articles and books. I’ve read only part of that literature: In none of it have I come across any mention of Polk’s necessarily anonymous contribution to George Seldes’ remarkable weekly, IN FACT, in late March 1948.

I began reading about the case in an attempt to understand American press acquiescence in the numerous obvious lunacies advanced by the Warren Report; and the better to measure Richard Starnes’ courage in writing "'Arrogant' CIA Disobeys Orders In Viet Nam” (Washington Daily News, 2 October 1963, p.3). It almost goes without saying that study of the Polk case did not diminish by an iota my wonderment at the sheer, bloody-minded fearlessness of the Scripps-Howard man. ...

Interestingly, the case was handled by the New York law firm of William Donovan, the first and only head of the OSS. Day-to-day responsibility for the case fell to a youthful lawyer called William Egan Colby, future Director of Central Intelligence. The titans of the U.S. press corps – Lippmann, Morrow, Paley et al – acquiesced shamefully and without exception in the ensuing official whitewash, including the arrest and prosecution of a “communist” patsy.

The example of Polk’s fate was surely not lost on American reporters at home and abroad. It would be interesting to know to what extent it dried up the flow of under-the-counter contributions by the mainstream U.S. press corps to Seldes’ publication.

The most recent series of arrests, deportations, and executions are “the result of the Greek government’s interpretation of the Truman Doctrine,” reports NYHT’s correspondent Homer Bigart.

So long as the British were in control, the monarchist-fascist govt refrained from inflaming world public opinion by murdering members of the Liberation force; now that the U.S. Embassy and military mission advise Athens, the govt proceeds with executions.

The NYHT is one of the few papers which has denounced these Greek murders. Most of the U.S. press is silent when anti-fascists are the victims.

U.S. Embassy Lie

On the day the U.S. Embassy issued the statement that “there is as real a freedom of the press in Greece today as there is in the U.S.,” the Greek govt jailed two editors “who are socialists (but anti-communists),” according to the NYHT, which adds that the “crimes” charged against them “had been committed against the German Nazi and Italian fascist occupation forces” years ago.

It is of course possible – but not probable – that the U.S. Embassy statement is not a lie, but an ironic commentary on the U.S. press, which is 99% reactionary, follows the N.A.M. line, was 95% against the New Deal and the general welfare of the majority; or just as “free” as the Greek press.

It’s truly stupefying that today, in the midst of the Obama era, that legions of Americans continue to find it so easy to rationalize and doggedly defend the Bush administration’s torture program.

As more details are revealed it’s clear that never before in human history has such a complex system of abduction, international rendition, and judicial and legislative manipulations been employed to advance and empower an extremely narrow yet far reaching political agenda.

Bush and Co. have turned American democracy on its head and redefined political criminality and neo-fascistic hubris while injecting their poison into the minds of untold millions of Americans via a compliant and self-serving media system. They have rendered Orwell’s horrific vision for the future of humanity in ‘1984’, quaint. But above all, what is most astonishing to me is how they have made my 86 year old Italian-Catholic, Jesus loving mother, embrace torturers and denounce Peace Makers.

My two brothers and I used to have a good laugh when my parents would talk about the ‘good’ Mussolini brought to Italy. For my entire adult life, spirited political hyperbole and great food have always been a part of my family’s dinner table experience. ‘Pass the ravioli – the Japs deserved two nuclear bombs!’ ‘How could you say such a thing I thought you believed in Jesus?’

A study released in April by the Pew Research Center for the People and the Press indicates the more often people attend church, the more likely they are to support torture. Sadly, the sobering data supports my own personal struggle growing up in an extremely conservative, Italian Catholic family. I will always remember my parents’ deep-seated belief that the biggest mistake ‘Il Duce’ ever made was aligning himself with Hitler (I think Hitler saw it the other way around) and how amazing my mother’s gnocchi were.

Even in the face of obvious political malfeasance and criminality, my parents always justified the ‘right’ and demonized the ‘left’. Diabolical acts like the bombing of Cambodia or My Lai or the blatant illegal dabblings of Richard Nixon, seemingly antithetical to the 12 years of Catholic education I received were always ‘justifiable’.

Although my mother would never admit it, she probably would grant the benefit of the doubt to the nefarious and twisted ambitions of the Inquisition. Murder and torture in the name of Jesus are ‘A- OK’, as long as the Pope gives his blessings, unless the Pope contradicts the President – then that’s another story. My mother is a truly wonderful and beautiful woman — she is just so profoundly frightened by what she has been told about the world, that her value system has been turned inside out.

My parents were children of Italian immigrants and have been ardent Republicans, defenders of Nixon, detractors of FDR, haters of the Beatles, unions, gays, environmentalism and consumer advocacy. As far as African Americans go, suffice to say that the angst ridden look on my parents’ faces is forever etched in my mind when I told them an African American girl (and Catholic) asked me to her prom and I accepted.

It was the first indication that I was on a different path. Although neither of them completed college, my father (now deceased) and mother were great, committed loving and intelligent parents who encouraged their three sons to aim high and achieve great things. But there was always this ever-present layer of fear based bigotry on their part that tainted our relationship and generated extremely frustrating and painful arguments.

Enrico Romolo Corsini was a proud first generation, Brooklyn born, Italian-American and a WWII and Army Air-Corps veteran. When we argued politics, he would always make me prove my claims. I would say to him, ‘Dad – the Soviet Union lost 20 million people during WWII’ and his classic response would be, ‘Show me where you read that! Who wrote that?…That can’t be true!’ and I would respond angrily, ‘Here it’s in your Encyclopedia Britannica!’ And I would open the volume and read down to the casualties. He was silent, then grumbled. Although it took a lot of effort, God bless his soul, Dad’s ego would succumb to the weight of evidence, albeit grudgingly. My mother is another story altogether. ...

People cannot support torture while claiming to be Christian – they are mutually exclusive. Just like fascism and democracy. Sorry Mom, I love you and your pasta, but you and masses of other right-wingers out there and not the Beatles, homosexuals, Muslims, hippies or rappers, have undermined the footing of American democracy.

You have abandoned your own Christian values of humility, forgiveness and compassion and have empowered craven, greed driven politicians to frighten our nation into submission. It takes far more strength of character to stand for peace, than succumb to war. This is why Jesus was tortured and murdered by people who feared the truth. Fascists all of them!

The Washington press corps still refuses to call the Bush techniques torture, adopting the lies of the government as truth, allowed brazen defenses of torture on its op-ed pages, has one columnist, Charles Krauthammer, who has pioneered and championed the torture of prisoners, fired anti-torture columnists like Dan Froomkin, and now want to cast a blessing on the torture program by singling out just a few who went beyond it. So they get the appearance of actually caring about the subject while protecting their friends from any unpleasantness caused by brutally torturing hundreds of prisoners. I mean: how can one invite Don Rumsfeld for a salon at Lally Weymouth's house if he is, gasp, a war criminal? But Rumsfeld is a war criminal, and he should be treated as such in Washington. He isn't. Because he is of their class. Lynndie England, doing what Rumsfeld told her to do? She went to jail. Rummy gets a fat book contract and invites to Washington parties. ... "

NSA's Cyber Overkill

A project to safeguard governmental computers, run by the NSA, is too big a threat to Americans' privacy.

Cyber security is a real issue, as evidenced by the virus behind July 4 cyber attacks that hobbled government and business websites in the United States and South Korea. It originated from Internet provider addresses in 16 countries and targeted, among others, the White House and the New York Stock Exchange.

Unfortunately, the Obama administration has chosen to combat it in a move that runs counter to its pledge to be transparent. The administration reportedly is proceeding with a Bush-era plan to use the National Security Agency to screen government computer traffic on private-sector networks. AT&T is slated to be the likely test site. This classified pilot program, dubbed "Einstein 3," is developed but not yet rolled out. It takes two offenders from President Bush's contentious secret surveillance program and puts them in charge of scrutinizing all Internet traffic going to or from federal government agencies.

Despite its name, the Einstein 3 program is more genie than genius -- an omnipotent force (run by the NSA via AT&T's "secret rooms") that does the government's bidding -- spying. The last time around, this sort of scheme was known as the "special access" program -- "special" being code for "unconstitutional."

Einstein 3 purportedly is meant to protect government networks from hackers. But cyber-security experts -- such as Babak Pasdar, who blew the whistle on a mysterious "Quantico Circuit" while working for a major service provider -- agree that Einstein 3 offers no intrinsic security value. The program is implemented where servers exchange traffic between one another -- in the heart of a network system rather than at the perimeter, which interfaces with the outside world. This is similar to a home security system that only monitors the central interior of a house, rather than keeping an eye on the actual doors (and the purpose of hackers may simply be to enter).

Furthermore, Einstein 3 focuses on collecting, processing and analyzing all person-to-person communications content rather than looking for hacker and malicious software attack patterns directed at government sites and installations -- which should raise eyebrows.


The prospect of NSA involvement in secret surveillance should set off alarm bells. The intelligence community lost any benefit of the doubt the last time it collected and read Americans' domestic e-mail messages without court warrants. Einstein 3 is based primarily on covert technologies developed by the NSA for the purposes of wiretapping.

The telecom companies also have lost their privacy cred. In a tacit admission that the proposed new program is problematic and possibly illegal, AT&T has sought written assurances from the administration that it will not be legally liable for participating in the program. The company was sued over its role in aiding Bush's electronic eavesdropping on Americans and, along with other telecoms, received retroactive immunity from Congress.

Earlier incarnations of the Einstein program observe predetermined signatures (specific patterns of network traffic), but Einstein 3 would look at the content of e-mails and other messages sent over government systems.

Moreover, while Einstein 1 and Einstein 2 passively observe information, Einstein 3 technology plans to use "active sensors." This is a tactic used by malware developers and is a popular feature of spyware that clogs up the Internet, slows down PCs and tips off hackers by emitting signals.

And most disturbingly, according to the Department of Homeland Security's 2008 "Privacy Impact Assessment," while earlier iterations of Einstein implemented signatures based on malicious computer codes, Einstein 3 could include signatures based on personally identifiable information. The privacy implications are great. Any citizen logging on to a ".gov" website would trigger this.

The IRS and other governmental agencies collect sensitive personal information for legitimate and limited purposes. However, strict confidentiality rules apply to that information. Although the Department of Homeland Security, which is managing the program, insists that the "main focus is to identify malicious code," we've heard such empty reassurances before.

Media reports indicate that government officials recently acknowledged during closed meetings of the House and Senate Intelligence and Judiciary committees that Americans' e-mails that were improperly gathered or read during Bush's warrantless wiretapping program -- even under the relaxed 2008 intelligence surveillance law -- were not just an "incidental byproduct." According to a former NSA analyst and two intelligence analysts interviewed by the New York Times, the e-mails could number in the millions.

Further, a government review of the Bush wiretapping program, released Friday, questioned the effectiveness of the surveillance efforts.

President Obama's federalization of many private systems and his adoption of the Bush administration's spying tactics are on a collision course that would expose many Americans' private data and communications to government scrutiny. I suspect that the public would be appalled that a taxpayer's financial information or a patient's medical records would be available to, much less perused by, the NSA. There are far less invasive network defenses that can secure government computing environments, such as upgrading good old-fashioned firewalls and filtering routers.

Obama came into office vested with vast new surveillance powers, which he voted for as a senator. Atty. Gen. Eric H. Holder Jr., while strenuously avoiding the word "illegal," called the original Bush snooping "unwise." But instead of trying to put the genie back in the bottle, Obama is considering expanding its power.

This is antithetical to basic civil liberties and privacy protections that are the core of a democratic society. Perhaps we can draw a lesson from the real Einstein, who ultimately regretted his role in urging the development of dangerous technology -- the atomic bomb -- and spent the rest of his life advocating against it.

Ex-CIA agent: Zubaydah waterboarded before DoJ memos approved

A former U.S. intelligence agent said in a report published Monday that terror suspect Abu Zubaydah was subjected to simulated drowning months before the Bush administration’s Department of Justice had written memos approving the use of waterboarding.

The claim strikes a serious blow to repeated Bush administration arguments that no laws were broken in the torture of prisoners because legal guidelines had been closely followed.

Former Central Intelligence Agency officer John Kiriakou, speaking with BBC’s Panorama, said that internal communications detailed Zubaydah’s torture beginning “at the very end of May or the very beginning of June 2002.”

Bush administration lawyers did not issue memorandum supportive of torture — a war crime under the Geneva Convention relative to the treatment of prisoners of war — until August of that year.

Kiriakou said that President Bush had personally given written authorization for Zubaydah’s torture.

The “official” story of Zubaydah’s imprisonment, as presented in a timeline released by the Senate Intelligence Committee and summarized by the Washington Post. According to this version, Abu Zubaydah was subjected only to traditional interrogation methods until an August 1 memo from Justice Department lawyer Jay Bybee gave a green light for the use of waterboarding and other aggressive techniques. The CIA asked the Office of Legal Counsel to furnish an opinion on the so-called “harsh interrogation techniques” in May, 2002.

On the other, there is a far more incriminating narrative that has been pieced together by various observers over the last several years. In this version, harsher methods were being applied to Abu Zubaydah as early as mid-April, and by mid-May he had been subjected to virtually every aggressive technique short of waterboarding.

This second version appears to be supported by a number of external facts. One is that in 2005, the CIA destroyed all videotapes of Abu Zubaydah’s interrogation from prior to August 1, even though taping had begun in April.

There were also two peculiar episodes of heightened security alerts in the US in April and May, which were said at the time to have been based on information obtained from Abu Zubaydah. These vague and ultimately implausible threats gave a strong impression that Abu Zubaydah might have been inventing al Qaeda plots simply to satisfy his interrogators.

“President George W Bush’s administration have steadily maintained that they did not break the law because they received legal advice which determined that waterboarding and other harsh techniques were not torture,” noted the BBC.

It was previously believed that former Secretary of State Condoleeza Rice was the first high-ranking Bush administration official to approve the torture of a terror war prisoner.

When it was revealed that the CIA destroyed tapes which showed the torture of Abu Zubaydah, then director Michael Hayden protested criticism, claiming the program fell in-line with legal guidance at the time.

“What matters here is that it was done in line with the law,” he said, adding that the CIA’s interrogation program has “helped disrupt terrorist operations and save lives.”

The interrogations have been carried out with “careful supervision” and were “built on a solid foundation of legal review,” he said. “If the story of these tapes is told fairly it will underscore those facts.”

Readying Americans for Dangerous, Mandatory Vaccinations

At least three US federal laws should concern all Americans and suggest what may be coming - mandatory vaccinations for hyped, non-existant threats, like H1N1 (Swine Flu). Vaccines and drugs like Tamiflu endanger human health but are hugely profitable to drug company manufacturers.

The Project BioShield Act of 2004 (S. 15) became law on July 21, 2004 "to provide protections and countermeasures against chemical, radiological, or nuclear agents that may be used in a terrorist attack against the United States by giving the National Institutes of Health contracting flexibility, infrastructure improvements, and expediting the scientific peer review process, and streamlining the Food and Drug Administration approval process of countermeasures."

In other words, the FDA may now recklessly approve inadequately tested, potentially dangerous vaccines and other drugs if ever the Secretaries of Health and Human Services (HHS) or Defense (DOD) declare a national emergency, whether or not one exists and regardless of whether treatments available are safe and effective. Around $6 billion or more will be spent to develop, produce, and stockpile vaccines and other drugs to counteract claimed bioterror agents.

The Public Readiness and Emergency Preparedness (PREP) Act slipped under the radar when George Bush signed it into law as part of the 2006 Defense Appropriations Act (HR 2863). It lets the HHS Secretary declare any disease an epidemic or national emergency requiring mandatory vaccinations. Nothing in the Act lists criteria that warrant a threat. Also potential penalties aren't specified for those who balk, but very likely they'd include quarantine and possible fines.

The HHS web site also says the Secretary may "issue a declaration....that provides immunity from tort liability (except for willful misconduct) for claims of loss caused, arising out of, relating to, or resulting from administration or use of (vaccine or other pharmaceutical) countermeasures to diseases, threats and conditions determined by the Secretary to constitute a present, or credible risk of a future public health emergency...."

The industry-run US Food and Drug Administration (FDA) notoriously rushes inadequately tested drugs to market, putting their efficacy and safety into question, and turning those who use them into lab rats. It includes everyone if a mass vaccination is ordered on the mere claim of a public emergency - no proof required.

The Pandemic and All-Hazards Preparedness Act (S. 3678) is the other worrisome law, effective December 19, 2006. It amended "the Public Health Service Act with respect to public health security and all-hazards preparedness and response, and for other purposes." Even its supporters worry about issues of privacy, liability, and putting profits over public health. Critics express greater concerns about dangerous remedies for exaggerated or non-existant threats as well as mass hysteria created for political purposes.

At least one other measure is also worrisome - The Model State Emergency Health Powers Act (MSEHPA). So far it's just a proposal by the Center for Law and the Public's Health - "A Collaborative at Johns Hopkins and Georgetown Universities (as) a primary, international, national, state, and local resource on public health law (and) policy for public health practitioners, judges, academics, policymakers, and others."

MSEHPA is now "track(ing) legal responses to the emerging international response to the 2009 H1N1 (swine flu) outbreak, including declarations of public health emergency at the international, national, state, and local levels...." even though forensic evidence can't confirm any H1N1 deaths. No emergency exists anywhere, and reporting one is all hype to sell dangerous drugs to unsuspecting people globally.

On its web site, the ACLU says this about MSEHPA:

It's "written in a way that doesn't adequately protect citizens against the misuse of the tremendous powers that it would grant in an emergency. (It's) replete with civil liberties problems. Its three top flaws are that:

(1) It fails to include basic checks and balances (by) grant(ing) extraordinary emergency powers (that) should never go unchecked. (It) could have serious consequences for individuals' freedom, privacy, and equality."

(2) "It goes well beyond bioterrorism (with) an overbroad definition of 'public health emergency" that may be anything a local or national authority declares for any reason with no conclusive evidence for proof.

(3) "It lacks privacy protections (and) undercut(s) existing protections for sensitive medical information."

MSEHPA worries other organizations besides the ACLU, both conservative and progressive - including the Free Congress Foundation, American Legislative Exchange Council, conservative association of state legislators, Human Rights Campaign, and Health Privacy Project.

The Real Threat of Dangerous, Mandatory Vaccinations

In the wake of the hyped Swine Flu scare, media reports suggest mass vaccinations are coming. The May 6 Kimberly Kindy - Ceci Connolly Washington Post one, for example, headlined "US May Add Shots for Swine Flu to Fall Regimen" without saying they'll be mandatory but reading between the lines suggests the possibility this year or later.

The writers report that "The Obama administration is considering an unprecedented fall vaccination campaign" to include regular and Swine Flu shots, the latter because it's "spreading across the globe."

HHS' Dr. Robin Robinson said "We are moving forward with making a vaccine," and if the government proceeds with a national program, enough supply will be produced to provide two doses for all Americans with spokespersons like National Institute of Allergy and Infectious Diseases, Anthony Fauci, claiming adverse reactions aren't to be expected and adding another shot for Swine Flu "should not present a problem."

The New York Times also hypes the scare with reports of city schools closed after unconfirmed Swine Flu cases, a few adult deaths blamed on H1N1 bringing the claimed total in the city to seven, and the World Health Organization (WHO) saying on June 3 that it's moving closer to declaring a worldwide (Level 6) Swine Flu pandemic - even though none exists.

With all the hype, misinformation, and willful lies WHO's Dr. Keiji Fukuda, in charge of flu, said only 117 deaths globally have been "blamed" on Swine Flu and any warning may include the caveat that the virus isn't very lethal. A more accurate statement would explain that no forensic evidence links any deaths to H1N1, and influenza annually kills about 30,000 people in America alone - something the major media never report or that scattered accounts of any type flu deaths worldwide are no cause for alarm or reason for scary headlines.

It's also unconscionable for the WHO, US and other nations' officials to spread lies, deception, and hysteria so major pharmaceutical companies can foist dangerous vaccines and other drugs on unsuspecting people, harming their health and making them vulnerable to later diseases and possible early deaths.

Massachusetts May Be A Forerunner of What's to Come

On April 28, the Massachusetts Senate unanimously passed a pandemic flu preparation bill that rises to the level of martial law. If approved by the House and signed into law, it will mandate among other measures:

-- "vaccination, treatment, examination, or testing of" all individuals involved in providing health care - as perhaps step one before ordering the same process for all state residents;

-- owners or occupiers of all premises "to permit entry into and investigation of the premises;"

-- closure, evacuation, and decontamination of all suspected facilities; and

-- restricting or prohibiting "assemblages of persons."

Other states may be planning similar measures as precursors to mandatory nationwide vaccinations and overall suspension of civil liberty protections. ...

Book Review: Aphrodite Jones's "The Michael Jackson Conspiracy" is a Whitewash

True crime reporter Aphrodite Jones has published a book, The Michael Jackson Conspiracy, with a foreword by Tom Mesereau, the pop singer's attorney, defending the accused pedophile.

Her views have changed over time, however:

Ms Jones, according to the San Ferndando witness, was "emphatic" about Jackson's guilt "in March of 2006." But as Jones herself tells it, she reversed her position earlier, in June 2005, when she "made her last appearance on The O’Reilly Factor related to the Michael Jackson trial," and "experienced a striking moment of clarity." A revelation: 'As I made one of my last public comments on the case,' she remembers, 'I realized that I had become one of the media bunch who had predetermined the outcome of the trial, wrongly."

So, after making multiple appearances on Fox News to argue Jackson's guilt, she is now equally emphatic in her belief that Jackson was innocent. Yet the book, she acknowledges, is a "conspiracy theory." So her confidence in her own book does not lead her to describe it as an airtight examination of Jackson's guilt or innocence - it's a "theory."

Who was behind the "conspiracy?" The media: "Throughout the trial ... the media found that it paid in ratings to serve extra helpings of snide remarks, smirks, and condemnation in their press reports." The condemnation here is seen as a deliberate strategy to boost ratings. No evidence for this startling revelation is offered. It's a "conspiracy theory."

Jones: "Our observations of Michael Jackson have become tainted. The actions of the media, if not explicitly intended, had the effect of deceiving us into believing that Michael Jackson was now 'really' wierd." Jones expects us to believe that the common perception of Jackson as a strange character originated with the press, not Jackson himself ... perhaps someone, somewhere, will believe that Jackson was well-balanced, a picture of mental health - someone on prescription drugs with a hundred face lifts in his or her past and children who drink alcohol. Someone with a hole for a nose, a Caucasian African-American with longstanding Mafia ties and a feminine speaking voice. Personally, I'd say that Jackson had fairly obvious issues, but perhaps the press has "tainted" my perceptions. Richard Nixon said he had the same problem ...

Jones's "theory" continues: The media - recall that she'd been on Fox News several times fuelling the lynch mob, so this is an indictment of herself ... Aphrodite, per her own criteria, was a News Corp. "conspirator" - was "carried away in reporting salacious and tantalizing news about Michael Jackson," and this had a "desensitizing" effect on our very perceptions: "A pop star which the American public had become enamored with had now evolved in our minds into someone unsavory."

Jones wrote this before Jackson died: "Even at the end of the day, in the lead-up to the announcement of the 'NOT GUILTY' verdicts on June 13, 2005, the media were still predicting doom and gloom for the King of Pop." And the press was correct. Death and despair were in the cards. But Jones sees in this prophetic point of view further evidence of "conspiracy."

But unlike most conspiracies, this one was overt. "There was no secret about what the media was doing."

But it wasn't just the press. Jones: "[Santa Barbara DA] Tom Sneddon brought a criminal trial against Michael Jackson because he's a publicity hound; he just wanted the whole world to be watching him."

How does Aphrodite Jones know Sneddon's deepest "ulterior" motives? Is she a psychic? In a blurb for the book, she boasts that she gets "inside the minds" of the central participants in the trial. Is that possible? Is that what a professional, unbiased reporter does?

Sneddon "just wanted the whole world to be watching him. If Sneddon won, and to try to assure this, Sneddon threw in every charge he could think of including the ridiculous conspiracy charges, then Sneddon's name would be up in lights in legal circles around the world." Jones states all of this as fact, not idle supposition, but might be hard-put to prove it. It may be true, maybe not - I don't know and don't pretend to know. Neither does Ms Jones.

Her psychic approach to journalism is plied elsewhere. When asked in an interview why Jackson agreed to a $20 million settlement in 1993, it was supposedly not an admission of guilt. Ms. Jones responds: "MJ was worth $200M at the time - and was ready to be worth double and triple that. So '$20M seemed like not much $ (at least to greedy advisors who just wanted MJ to work and get paid for doing music and not bother with lawsuits!"

Anyone who believes this explanation is as biased and psychic as Jones. Jackson didn't cry blackmail, as any innocent person would have done. He didn't contact the police himself to demand an investigation of the alleged extortion.

He paid the "modest sum" of $20 million, only a tenth of his net worth, to silence his accusers (not an original argument).

The media haven't persuaded me that this is so. Jones may be capable of reaching into anyone's mind and extracting one's true, unsavory motives - but her journalistic methods are quackery and not on par with her "psychic" gifts or inane "conspiracy theorizing." In the book, she does make a decent point or two - the media, including herself on Fox, DID go to far - doesn't it always? The recording industry DOES devour its own talent. But why no mention of Jackson's organized crime connections? Why no mention of his shady associates, occultism, anti-Semitism, ties to Scientology, dubious accusations of conspiracy levelled against Mitollo and Sony, his evident mental decline?

Because those acknowledgements would lead us away from the premise that Jackson was an innocent, abused genius, and the book is nothing if not leading.

And Aphrodite Jones was in the midst of it, an informed reporter on the O'Reilly Factor, adding her pre-revelatory two cents, "tainting" our perceptions, conspiring against Jackson. She was at the core of the media "conspiracy," and so much of the book's criticism of the Fifth Estate is ultimately about herself, though she often seems to forget this fact.

She was one of the ranking conspirators ... but doesn't let us in on her own illicit motives. Was it profit, as she has maintained categorically of the "conspirators?" And what is her motive now?

St. Louis connection to Michael Jackson: Attorney Alvin Malnik

TWO DEGREES OF SEPARATION: South Florida kingpin and St. Louis native, Alvin I. Malnik, 76, has been getting a lot of face time since Michael Jackson’s death. Malnik — a product of Clark Elementary School, Soldan High and Wash U. — was a friend of Jackson’s for a long time and says the King of Pop asked him to become godfather and parent to Prince Michael II, “Blanket” if anything happened to Jackson.

Malnik has been interviewed about his connections to Jackson by NBC’s Today Show, CBS and the Palm Beach Post, among others. Malnik is an attorney who had close ties to mobster Meyer Lansky and was at one time considered Lansky’s “heir apparent.”

Malnik has said he signed a document in 2003 saying that he could take custody of Blanket if anything happened to Jackson and that he also agreed in writing to be the executor of Jackson’s estate. Malnik says that Jackson at the time became the godfather of Malnik’s then 11-year-old daughter, Spencer. Jackson and Malnik reportedly had a falling out in the past couple of years. The cause of the estrangement is unclear.

Jackson used to seek refuge in Malnik’s 15-bedroom, 35,000-square-foot Palm Beach County mansion in Ocean Ridge. He reportedly would stay there for months at a time with his children and an entourage. Malnik was Jackson’s attorney and said he helped him refinance his debt with Sony and the Bank of America. Malnik also was the owner of the exclusive Forge restaurant in Miami, which he sold to his son Shareef.

Jackson sat with Malnik at the head table during Malnik’s 70th birthday bash at the Forge in 2003, which was attended by my predecessor at the Post-Dispatch, Jerry Berger. Berger was a longtime friend of Malnik’s. He
wrote about the party that “the invitation to Florida itself was unique: a taped message from the King of Pop himself, Michael Jackson. But the event lived up to its billing. Jackson, accompanied by a full phalanx of bodyguards, was on hand to welcome Malnik’s guests, including B.B. King, Smokey Robinson, F. Lee Bailey and celeb lawyer Roy Black.”

Berger included the names of some of Malnik’s St. Louis pals who were at the shindig: Attorney Martin Green, merger and acquisitions mogul Gilbert Kopolow and L.A.-based sales exec Barry Gelber. He said the Harbour Group’s Sam Fox and his wife, Marilyn, friends of Malnik’s since high school days, were no-shows but were represented by a magnificent floral masterpiece from the Fox den.

Malnik also turned up with a connection to St. Louis County Executive Charlie Dooley. His name was on a list of campaign contributors as having donated $2000 to Dooley’s unsuccessful campaign for Congress in 2000; Dooley was
a St. Louis County councilman at the time.

Police Hunt for Michael Jackson's Doctor's Aide

Michael Jackson's personal doctor Conrad Murray was plunged further into the centre of the "homicide" riddle last night as detectives began searching for his assistant.

Emails written by Stacey Howe were seized by police in a criminal investigation into the singer's death.

Two messages sent from Ms Howe's email account are now being examined by detectives trying to find out why Jackson was prescribed lethal doses of prescription drugs.

The latest development comes amid reports that documents at a storage centre and a lock-up owned by Dr Murray were destroyed as Jackson lay dying - with suggestions of a possible cover-up.

Police also revealed that Dr Murray, who could face manslaughter charges, confessed to keeping a secret drugs cupboard at Jackson's mansion.

A search warrant filed with the Los Angeles courts on Thursday formally names Dr Murray as the key suspect in a manslaughter investigation into Jacko's death.

The men in charge of Michael Jackson's estate have recovered a missing £3million - secretly hoarded by the star's financial adviser. Dr Tohme Tohme handed over the money to lawyers administering the late star's estate this week. But he insisted the singer always knew he had the cash. The Lebanese doctor claimed Jackson gave him the money to buy a house in Las Vegas.
